THE EMPLOYEE WAS AT THE FACE MEASURING ORE RESERVES, THERE WAS A MINER AT THE TOP OF THE SLOPE MINING. A GILSONITE CHUNK BROKE OFF, ROLLED DOWN THE SLOPE AND HIT THE EMPLOYEE IN THE CHEEK.

EE states that after punching a 2.5' set of drift in conglomerated Gilsonite and rock, that he tested a rock in the back for stability, after he determined it to be solid, he started cutting his hitch when a piece of the rock came off, striking him on his right leg, causing a fracture to his knee and ankle.

While mining with a chipping hammer, a rock rolled down the slope and hit him in the head. Received a bump on head, went to hospital. He reported that the hospital told him he had a concussion. Employer has not seen that report from the doctor.
