Employee left work at 7:00 am on 7/21/08 complaining of a sore back. On 8/8/08 employee claimed injury was caused by under inflated air cushion seat bottoming out when travelling over uneven terrain.

EE WAS OPERATIING A SHUTTLE CAR AND HAD JUST RECEIVED A LOAD OF COAL FROM CONTINUOUS MINER. HE TRAMMED FROM FACE & MADE THE TURN TO GO WEST TO THE FEEDER. OPERATOR OF 2ND SHUTTLE CAR WAITED FOR EE TO CLEAR THE INTERSECTION. 1ST CAR HAD TO BACK UP A SHORT DISTANCE TO CLEAR THE LEFT RIB. OPERATOR OF 2ND CAR THOUGHT HE HAD CLEARED THE INTERSECTION & PULLED FORWARD STRIKING 1ST CAR.

EMPLOYEE WAS PULLING TH EMINER CABLE WITH HIS BACK TOWARD THE SHUTTLE CAR. THE SHUTTLE CAR WAS PULLING AWAY FROM THE MINER ON A SLIGHT PITCHED ENTRY, THE LOADING END OF THE SHUTTLE CAR SLID T O THE SIDE AND STRUCK THE EMPLOYEE.
