PLEDGE FIRST BE1AN HAVING SHOULDER PROBLEM IN JUNE 1985 AND UNTIL RECENTLY HE AND HIS DR FELT IT WAS AN ARTHRITIS LIKE CONDITION IN LATE JAN 1986 AFTER CONTINUEL PAIN TEST SHOWED A TORN ROTATO CUFF IN THE RI1HT SHOULDER ALTHROUGH NO ACTUAL ACCIDENT OCCURED IT WAS FELT THAT OPERATION OF BULLDOZER AND OTHER EUIPMENT FOR OVER 18 YEARS CONTRIBUTED TO OR CAUSED THE PROBLEM FROM CONTINUA

PLEDGER WAS CLIMBING OFF BULLDOZER HIS RT HAND WAS HOLDING ON TO HANDRAIL HIS RT FOOT WAS ON PUSHARM & WHEN HE MOVED HIS LEFT FT FROM PUSHARM TO GROUND IT SLIPPED IN MUD SLIP OCCURRED JUST AS HE WAS RELEASING HANDRAIL AS HE FELL TO THE GROUND HIS LEFT ANKLE WAS SPRAINED
BROWNS ASPHALT PAVING WAS PREPARING TO SEAL COAL A ROAD. AN AC-5 ASPHALT ROAD OIL HAD BEEN PUMPED INTO THE ENTYRE ASPHALT DISTRIBUTOR AT 360 DEGREES F. WHEN THE CIRCULATION PUMP WITHIN THE DI STRIBUTOR WAS STARTED BY HAMBLEN THE HOT OIL BUBBLED UP AND OUT OF THE TOP HATCH OF THE DISTRIBVUTOR COVERING HAMBLIN AND CAUSING 2ND AND 3RD DEGREE BURNS. PROBABLE CAUSE WAS MOSITURE FROM
WHILE LOADING A TRUCK WITH LIGNITE WITH A SHOVEL, HOOTEN ENGAGED THE HOIST LEVER WITH HIS HAND WHILE SIMULTANEOUSLY RELEASING THE HOIST BRAKE PEDAL WITH HIS RIGHT FOOT. THE PEDAL THEN JUMPED U PWARD STRIKING THE BOTTOM OF HIS RT. FOOT. X-RAYS SHOWED HIS RT. ANKLE TO BE FRACTURED IN TWO PLACES. A HOIST SHAFT PEDASTAL BEARING CAP FAILED CAUSING THE BRAKE TO JAM.
