The excavator operator told everyone ee was getting off excavator to take a restroom break. EE didn't listen and back into excavator boom with rock truck.

Employee was hauling over-burden to the dump in a 777C Cat rock truck, Equip. #301. When he started downhill to the dump area he noticed he had no brakes & went thru berm & over about 25' high dump. He went cab first into spoil bank. It threw him face first into windshield. He was not wearing seat belt.
Loader bucket slipped off a rock and the jar from the loader caused pain in his lower part of his back. He also said he had some pain the day before.

EMPLOYEE WAS SETTING IN ROCK TRUCK GETTING LOADED, LOADER OPERATOR WAS PUTTING BUCKET OF ROCK IN TRUCK. A BIG ROCK ROLLED OUT OF BUCKET STRIKINGSIDE OF TRUCK STRIKING EE. EE WAS COMPLAINING ABOUT PAIN AND STIFFNESS IN HIS NECK AT THE END OF THE SHIFT.
OPERATOR SAID THAT HE WAS HAVING PAIN IN HIS BACK AND THAT IT GOT WORSE DURING THE SHIFT.
