DEP insp drove his DEP vehicle out onto the bread work between 2 seed ponds, which is against MSHA regulations. DEP inspector had been warned against doing as he'd done this previously, there was 8' & drifting snow and ee told him to stop, leave his vehicle was unsafe. DEP inspector then got in his vehicle turning around and floored it, hitting ee with vehicle left Targe property.

When exiting the loader a gust of wind blew the door closed. While trying to catch the door from closing on him, EE slipped on the stair deck. In an attempt to stop his falling, he reached for a hand hold, straining his left shoulder and bicep. And irritated a nerve in his cervical spine (neck).
