Occupational Illness: Employee was diagnosed with Occupational Pneumoconiosis (Black Lung). Workers compensation notified the mine site on 9-9-2010.

Employee was cutting piece of belt with utility knife on old 2 west No.1 belt line, knife slipped and cut thigh above the right knee and lacerated leg 3 to 4 inchs long.

A control switch needed replaced on the cooks branch elevator. The elevator was taken out of operation at 8:00 A.M. and was put back into service at 9:00 A.M.. No miners were working under ground during maintenance on the elevator.

Employee stated while walking the James Creek barrier airway, he slipped on muddy surface and twisted his right knee. The employee did not start missing work until August 3rd, the diagnosis was received on August 4th showing 2 torn ligaments and a torn meniscus. The Doctor took the employee off of work to schedule surgery.

Employee were removing debris from the track. While removing debris, a timber dis-lodged from the mine roof and began to fall. The injured employee grabbed the timber to deflect it and at the same moment another employee tried to use a pick to deflect the timber away. The injured employee was struck with the pick and his outer-most metecarpal was fractured.

A roof fall was discovered on the main ""B"" conveyor belt. The fall extends from approximate belt location 2550 to 2635 and is approximately 6 to 8 ft thick.

The employee was walking to his work area and slipped in mud causing him to do a split. The employee was sent via ambulance to the hospital and diagnosed with a possible tear in his groin area and placed off of work to give the area time to heal.

Employee was cleaning up debris near the radius switch, when a rock slid off of another rock, striking his right ankle. Note: Employee did not begin missing work until 4-30-2010 and was not placed off work until 5-5-2010.

Employee stated that had just put up his outside bolt in the seventh row of the cut. He was walking beside the machine to retrieve a half header to support a kettle bottom when the coal rib rolled out striking him in the lower back. He was placed off of work by his treating physician for physical therapy on 2/22/2010.

Upon inspection of James Creek Emergency Hoist, the examiner discovered that a switch needed repair so the hoist would operate as intended. The hoist was set up manually and was manned by an operator until the repairs could be made at 7:00pm.

Upon inspection of Cook's Branch Elevator Shaft, it was discovered that the elevator doors were not properly functioning. The rollers on the right door were broke and required repair before the elevator could continue operation. This shaft is not used to portal miners or supplies and is not the primary or secondary means for escapeway from the mine. The elevator was repaired.

Occupational Illness; Employee reported that while reaching over bolt machine he felt a sharp pain in his lower back. Employee stated that he aggravated his back and had been having trouble with it due to an old injury. Employee has had two back injuries. Note: Mine Site did not receive medical until 2-16-2010

Occupational Illness; Employee has prior injuries to shoulder and injured it badly in a roof fall in 2007. Reported that he was unpluging scoop batteries and began hurting. Sought medical treatment on 2-2-2010 and was referred to family Dr that placed him off work for physical therapy and medication for pain. Note: Mine Site did not receive medical information until 2-12-2010

Upon inspection of the Cooks Branch elevator shaft, it was discovered that the elevator doors were not properly working and needed to be repaired. This shaft is not used to portal miners or supplies and is not the primary or secondary means for escapeway from the mine. Parts have been ordered to repair the doors and the mines will continue to maintain the elevator.

The evening shift Maintenance Supervisor, suffered an apparent heart attack when arriving to the working section. He was transported to the hospital and pronounced dead at approximately 8:30 pm.

Miner was walking up to the miner helper to relieve him for lunch and a rib rolled out that struck his side. He later went to the specialist and was placed under doctor's care. The miner was diagnosed with radiculopathy and right foot sprain. The mine site did not receive medical diagnoses until 12-29-09.

The A-belt section was pillaring and the right side MRS jack weighted up at 3:00 pm. The crew decided to pull out of the entry with the equipment and the left MRS jack would not tram past a hanging rock and gob. The hanging rock fell from the mine roof around 4:30 pm and the crews used the miner to free the MRS jack.

During the examination of the Cook's Branch Elevator Shaft the electrical examiner noticed that the governor rope needed replaced. The governor shaft also needed straightened. This elevator is not used as an escapeway or primary method to portal men into the mines.

Occupational Illness, Miner carrying timber and slipped. Miner went to specialist on 9-9/ medical received on 9-14/ diagnoses,""Clinical impression is contusion/sprain of left knee with pre-existing degenerative changes, Post Op Changes, and Tibial Osteotomy from prior injuries and surgeries. X-ray shows positive degenerative changes/ post op changes, and negative acute trauma"".

The roof bolt crew finished bolting the face of #6. The miners backed out of the face and turned the machine off when a rib rolled off from behind the line curtain. The rib measured 6' L, 8"" W, and 20 "" H. The rib struck the miner in the lower back/legs. The miner had pre-existing back problems and was diagnosed with a lumbar strain. Medical was not released until 8-18-2009.

The #11 motor was pulling the track duster to the James Creek Section while being followed by the #10 motor. The #11 motor ""saddle bagged"" in a dip and was struck by the #11 motor. The employee that was riding as a passenger in the #10 motor was diagnosed with a lumbar strain and contusion to the left knee. Medical diagnosis was not received at the mine site until 8-20-2009.

Miner stated, ""I was loading high-line cable into a sled and raised up striking my head against the roof. I was just ""stoved"" up."" Mine site began investigation to determine reportability. Please note that the initial medical report on miner was received on 7/30/09. A medical diagnosis was received on 8/4/2009 diagnosing the miner with a lumbar sprain/strain.

Occupational Illness. Miner reported pain in his right elbow on 6/26/09. On 7/12/09 he sought medical treatment after a two week vacation period. On 7/16/09 he was seen by a specialist and diagnosed with right elbow epicondylitis due to repetitive motion and was placed on Dr's care for physical therapy. Please note that mine site received medical report on 7/27/2009.

Employee walking from vehicle to the office to begin shift & tripped on the drain. He fell injuring his left hand, fracturing his outer-most metacarpal bone near the joint of his little finger. Please note that the reportability of this accident was not determined until 7/31/09 when the operator received additional information proving that an injury occurred on mine property.

Employee stated that he was carrying a 7 foot heitzman jack when his foot slipped on a piece of plastic pipe causing him to fall against a fiber crib. He said he felt pain in his right hip and lower back. He fell to his knees, then backward with the jack on top of him.

When checked, it was discovered that the Cooks Branch Elevator would not operate properly. After further investigation it was discovered that the door button had a short. The elevator is not used to transport men and probably does not fall in the category of reportability.

The fire-boss discovered a roof fall in the escapeway while making his rounds. Two seperated adjacent escapeways exist and the lifelin and escapeway was routed around the fall. The fall area was timbered and breakered off to prevent travel from all sides. The fall did not occur above the anchorage zone of the bolts.

Employee was making a splice in a conveyor belt. While pulling the belt together with a chain ratchet, the top stucture broke off, causing the handle from the belt stucture to strike the employee on his jaw.

(A) section experienced an unintentional rooffall on the active pillar section pulling 3 rows of roof bolts. The fall measured approximately 15ft. wide by 6ft. high trapping 2 Mobile Roof Supports.

Employee was working in the panel of a coal hauler and was kneeled down beside the rib. A small part of the rib rolled off and while moving away from the rib it struck the employee twisting his Ankle.

A roof fall was discovered by the examiner approximately 20' long, by 15' wide by 5' thick. The fall will not be cleaned up.

The employee stated he was operating a shuttle car and ran over a rock. He got out of the shuttle car to move the rock and when he bent over he felt a pain in his back. He stated he did not touch the rock. He had been diagnosed with degerative changes in his back.

The employee stated he was in a mantrip coming outside. The operator ran into the back of another mantrip that had stopped in front of their trip to let a motor come out of the side track. The employee has been diagnosed with degenerative disease in the back.

The employee stated that while walking down the beltline he stepped in a hole and twisted his ankle. The hole was approximately 14"" wide, 17"" deep and 2' long.

The employee stated that he was sitting in the deck of a locomotive when the safety chain hook caught his finger between the frame of the locomotive and the hook and avulsed his little finger.

The elevator at Cook's Branch became inoperative for more than 30 minutes while the daily examination was being conducted. EE was performing the exam when the elevator stopped. The EE was released at 10:45 am from the elevator and repairs were made to restore the elevator to working condition.

The employee stated he was installing a cable bolt at break five when he started to push the bolt into the hole the plate caught on a track tie and caused him to feel pain in his shoulder. The employee did not start missing work until 1/2/08. He was diagnosed with arthritis and severe degenerative changes in the shoulder.

A roof fall was reported that was an old fall. The investigation revealed this to be an old fall that had rode out the breaker timbers. The fall was located in the old belt entry adjacent to station 7203 and inby station 7228. The fall was breakered off.

The employee & 3 other employees were putting blocking under the cat pads & the operator was on the other side of the miner with the remote. The operator let the stab jack up & mashed the EE's finger between the cat pad & the crib block.

The employee stated he was getting into the F350 pick up truck and bumped his head against the door frame and jammed his neck.

The employee stated he was helping unload 60 pound steel from the rail car to install on the section. He lost his grip on the rail tongs when the end of the rail was removed from the rail car and dropped suddenly. The rail tong struck his left foot.

The employee stated he had tied a shieve around a rib bolt and used it to remove the belt drive. He went to unhook the shieve when a rib roll struck him on the right shoulder and right leg. The employee did not start missing work until 8-29-07.

The employee was walking to turn the belt on when a bat flew at him and as he ducked to avoid the bat he contacted his head against the hoist car causing a laceration to his forehead.

Two employees stated he was throwing material across the trolley wire when his hand contacted the trolley and another employee used a wooden crib to push him away from the power. He sustained an injury to his shoulder.

The employee stated he stepped back to shut off the longwall face conveyor when he felt a pain in his back. The investigation is not complete due to incomplete medical information and not being able to contact the employee. The employee continued to work until 8-8-07 when he started missing work.

The James Creek Emergency escape hoist for the primary escapeway of the Longwall section 060 and 2-East to James Creek did not function in automatic mode when inspected. All men were removed for the affected area until a qualified person was stationed at the escape hoist building to operate in the event of emergency.

The employee stated he was cleaning up rock and coal at the 24 shield when a rock slipped off the pile and struck his right finger. The employee received five sutures.

The employee was operating a coal hauler when it hit a hole in the bottom causing him to strike his head against the canopy. Due to unavailability of the doctor and the mine being on miner's vacation, this incident is now being reported. The employee has degenerative changes along his spine.

A roof fall was discovered on the 2 Right James Creek abandoned section. The fall was a continuation of the gob where the longwall had finished mining. The fall was approximately 100' long by 18' wide by 5' high. The fall will not be cleaned up but will be breakered off.

The EE stated he was cutting bit lugs off the shearer drum, preparing to replace four broken lugs. He was struck by a rib roll form the longwall face that was approx 6"" X 12"" X 2 1/2"". **This report is being modified to show the incident as immediately reportable. The operator disagrees and only submits to abate citation.**

The employee stated he was asked to pick up some supplies on the Mac-8 mantrip. He was driving in front of the bathhouse when he tried to avoid the speed bump in the road and struck the guard rail. He stopped suddenly and contacted the steering wheel with his chest. He was diagnosed with four fractured ribs.

A roof fall was discovered by the examiner on the 3 Right 2 East area in the cross cut adjacent to station 5231 between no. 2 and no. 3 entries. The fall was approximately 6' high x 20' wide x undetermined length. The fall will not be cleaned up but will be breakered off.

The EE stated he was helping 3 other EE's lift a belt impact slide on the belt rails approx 55"" high. He felt pain in his back.

The employee stated he was traveling in mantrip when the breake failed on the mantrip & the bus ran over the derail bug. He felt a pain in his back. The EE has been diagnosed with degenerative changes in his neck & back.

The EE stated he was removing a spindle from the belt when he lost his balance & fell. He as been diagnosed with severe bilateral degenerative arthritis of both knees. He did not go to dr until 5/6/07.

A roof fall occurred on the 3 Right section track and belt entry. The fall was approximately 30' long by 20' wide and 6' high. The fall will be cleaned up and will be resupported.

The employee stated he was moving a shuttle car to the outside and the shuttle car had knocked a couple of the header supports and had fallen down blocking the wheels. He moved one of the supports and the next day reported that he had pain in his left shoulder. He continued to work until 6/25/07. He had surgery and started missing on this date.

The employee stated he was installing a bolt when a brow fell off therib and rolled and struck him on the left leg.

The EE stated he was bolting top in the belt entry belt channel. The roof was 9' 10"" high. He started to put glue in the hole and stepped on the drill pot, when he slipped and fell on his right side.

The employee stated he was setting timbers when he felt pain in his stomach. He did not report anything until 3/9/07. He was diagnosed with a hernia to his stomach on 3/21/07. He continues to work.

The employee was observing the slack being taken up on the bolt machine cable reel. He stated that a loop of cable was around a rib board pulling tight as he was stepping across the cable and it struck him on the inside of the left ankle. The employee did not start missing work until 3/8/07.
