Doing service work on Dozer. Oil filter on extremely tight. Was using 1/2" ratchet. Would not budge. Hit ratchet with 4 lb. hammer. On the 5th swing, he missed the handle and hit his thumb.

Injured was replacing a leaf spring on a school bus. While positioning the spring on the front axle, the spring slipped off the axle and caught his finger betwen the spring and a crib block lacerating the little finger which required stitches and medical treatment.

EE & others were replacing the top belt on the #2 belt press. Takeup assembly was secured with a 3/4 ton chain come-a-long, both air regulators were backed off so as not to apply pressure & a stand with a 2"x12" steel pipe was holding the new belt. The air valve was opened & the takeup swung forward, broke the chain & the pipe struck the injured on left ear which required stitches.

While opening the door on a rail car, used slate bar to open door. Stuck slate bar in door release to turn open and release, skipped a tooth causing employee to slip down to knees and bar hitting track rail with right thumb between rail and bar mashing right thumb.

Employee was traveling on mantrip looking for scoop. He backed up to let another vehicle pass. As he moved forward he struck a rib causing the steering column to move out of control. The steering column hit his right hand causing fractures.

Injured was holding a bundle of resin glue cartridges in his left hand and was using a razor knife in his right hand to cut off the plastic wrapping when the knife slipped and cut the index finger on his left hand. The laceration required 6 stitches.

EE was operating fuel truck when he reached over to get material from seat lost control and drove into a ditch. The truck turned slightly onto its side. The EE was not wearing seat belt and struck top of his head, resulting in a laceration requiring seven staples.

Employee was operating front end loader in pit when rock fell from the highwall striking the loader and bending portion of the cab entrapping the operator's right foot. It took approximately 45 to 60 minutes to free the operator. Employee was released from hospital the same day; slight contusion, no fractures or other injuries.

Employee stated on 8/03/06 that he had pulled a muscle in his lower back while tightening lug nuts on a truck tire. He notified company of the alleged incident after receiving pay minus a previous pay advance which the company paid because he was considered a voluntary quit. His 1st Dr release for "illness" from 7/25 thru 7/29; 2nd release from 08/03 thru 8/07 "no remarks".

Employee was removing lip saver from bucket of 340 excavator with sledge hammer. A small piece of metal struck his lower right leg. The piece of metal was removed and four stitches were required. The employee returned to regular job at full capacity the same day.

Injured was operatng an S&S 488 scoop. He went to park it in #3 entry. As he was coming to a stop, he placed his right hand on top of the canopy. The sccop came to a stop & caught his right hand between the canopy & rib.

Employee scraped his knee while coming off the steel. He had a mild abrasion (similar to a carpet burn) and continued to work until 7/7/06 when he went to the doctor for an infection of the knee. Management was not made aware of his medical visit until 7/19/06 when notified by comp carrier.

He continued to work until 6/6/06 at which time it was determined to be fractured & a pin was put in the wrist 6/7/06. The employee is a highwall miner supertindent and has continued his regular each scheduled day with restricted sctivity

Employee alleges the injury occurred on May 26, yet he worked twelve hours that day. On or about May 27/28 his supervisor noticed that the employee's finger was bandaged. The employee stated he had cut his finger at home and did not report an occupational injury; later he filed a WV Worker's Comp claim on Sept. 30. The employer became aware of this on Oct. 13 and is protesting.
