After opening trailer doors, the driver walked back to the cab of his truck and proceeded to climb the steps to get back in the cab when he suddenly fell backwards onto the ground striking the back of his head.

Cause is unknown. Ee was installing a dust prevention tarp across the port hatch opening before the incident. The operator contests MSHA jurisdiction.
OUR DRIVER WAS ON TOP OF OUT SEMI TRAILER OPENING THE CENTER HATCH IN ORDER TO BE ABLE TO RECEIVE BULK CEMENT. IT APPEARS THAT THE DRIVER HAD ALSO TAKEN A TUBE OF GREASE TO APPLY TO THE LATCHE S FOR THE LID OF THE SEMI TRAILER. WHILE ON TOP OF THE SEMI TRAILER OUR DRIVER WITHER SLIPPED, LOST BALANCE OR SOMETHING, CAUSING DRIVER TO FALLTO THE GROUND.
