Employee was hand-loading cobbles into loader bucket to clean around base of stairs. He was facing away from the loader and tossing cobbles backwards. Cobbles were next to a metal platform. He struck left elbow on metal frame causing large contusion just above elbow.

Employee alleged that he had suffered neck strain from wearing his hardhat. He then alleged that it was actually a lower back strain from operating CAT D350 haul truck (S/N 9LR00727) during pit haul. Employee reported injury 5 days after injury and had indicated on time sheet that he was not injured on 9-9-05.
