A death of an employee occurred on or in the Ohio River. The death is still under investigation & the autopsy report has not been released. The cause is unknown at this time. Report is being filed under protest due to jurisdictional issues yet resolved. The deceased was working on empty barge when last seen. Upon his disappearance, a search commenced & his body found approx 2:30am.

Victim was in operation of Genie S-85 aerial lift when the lift became caught on exterior wall girt of building under construction. In an attempt to free the caught basket the machine's boom reacted after the basket came free, resulting in the victim's head receiving injuries which were fatal.

Owner of J&P equipment cleaning was working on a steam cleaning engine when one of his employees noticed that he was slumped over the engine. This is still under investgation by MSHA.

While repairing a gate post, three employees, using a service truck and a Cat 950B loader, "to reshape the post". While the loader was moving into position its brakes failed and overran his intended point and an employee.

All we know is a call came 10/29/08 about 8:00 a.m. that we had a fatal accident at Kennecott; our driver was killed by a pipe falling off the top of load on trailer. All Bob Orton Trucking does is haul the load (this load from WL Plastics Corp, Cedar City, Utah). We do not load or unload product.

Employee received fatal crushing injuries while operating haul truck, parked in line waiting to be loaded at the shovel. The employee exited the cab and was standing behind the cab, between the cab and air receiver tank when the truck in front started to move in reverse, pinning the employee.

Building a road when dozer overturned. Zero witnesses to accident. Dozer rolled down steep 80 foot incline.

Employee was disconnecting drawbar from dolly on outby end when trail motor collided with dollies and pushed dollies and employee into outby motor fatally injuring employee.

Victim was scaling in level 9 north 8 when a large rock fell from the roof crushing the cab of the scale machine causing fatal injuries. The accident is still under investigation by MSHA and the mine operator. The root cause analysis is not complete at this time.

WHILE OPERATING CONTINUOUS MINER, THE OPERATOR PINNED HIMSELF BETWEEN THE MACHINE AND A COAL RIB.

The Employee was on the surface of a clean dry barge in daylight hours with no movement and light wind. The Ee passed through the #2 port hatch opening and made contact with the empty hopper floor. Cause is unknown. Ee was installing a dust prevention tarp across the port hatch opening before the incident. The operator contests MSHA jurisdiction.

Two employees (welders) were dismantling a large tool rack. The welders were cutting 8'X4"X1/4" plate steel from the frame. The rack became unstable and tipped over on top of the employees. One employee sustained fatal injuries and the other received injuries to his back and legs.

Employee was assisting in the movement of supplies at the Justice Mine of Independence Coal Company, Inc. During this process he was apparently pinned between a parts car loaded on a rail car and a rib near the first left switch.

The employee was attempting to add a piece of angle iron to the discharge gate to the surge pile feeder. After welding, the gate did not fit properly. He crawled to the gate to investigate. He asked a co-worker for a tape measure. While waiting for the tape measure the material started collapsing around him. As a result the employee was engulfed in the material.

Employee was driving along roadway at approx. 5:30 a.m. The vehicle he was driving went through a berm and landed in approx. 45' of water. Employee was found outside the vehicle.

While working a steep backfill slope doing reclaimation work, the dozer operator was unable to maintain control, resulting in rollover of dozer approx 4-5 times. Although wearing seatbelt, a broken back and swelling of C-spine resulted, causing loss of sensation and paralysis.

Employee was pushing material (shot rock) from a break down shot, when his dozer went over edge of highwall. At this time accident is under investigation by MSHA and OMSL.

The victim had been instructing persons making a belt splice. He fell through a 4 foot by 6 foot opening 28 feet to the floor below.

For reasons unknown at this time, the victim came out of the truck and was run over by the truck.

The contract employee was helping to install a counterweight on Gradall XL5110 Scaler. As the weight was lifted into place, one of the connector links of the chain used for lifting broke, causing one end of the weight to strike the ground. This in turn broke the other end, which allowed the weight to strike the employee as it fell.

Employee (electrician apprentice) and a co-worker (journeyman electrician) were working on a light fixture of the SX upper tailings booster when he came in contact with energized wire.

EE was found unconscious, with no resp or pulse pit between hydroseparator and floc building. CPR was administered and EE was transported to CMS where he was pronounced dead. Autopsy report has not been recieved. A heat trace tape was found arcing near where EE was found.

Employee was marking locations to install roof bolts, a piece of slickensided rock fell striking the employee's head and crushed his head against the drill station canopy.

Unknown, most likely human error. Employee passed away on 7/25/08.

From accounts of person involved in accident, EE was preparing to tram Feeder onto belt tail during 3 East belt move when power cable for Feeder was dropped. It appears it fell across tram controls undetected. When EE activated start control switch, Feeder Hydraulic Tram Circuit engaged causing it to tram toward him, striking him & pinning between Feeder & coal rib.

Fatality due to roof fall at the face of a working section. **The fall pinned the victim between the roof fall and the coal rib. Retreat mining was taking place in the 003-0 section at the time. Fall was approximately 30 feet wide, 20 feet long and ranging from 4 inches to 4 feet thick.**

Employee was involved in a fatal rail haulage accident. The accident investigation is on-going. EE-fatally injured while transporting two flats of supplies along the 3-west track haulage. Other ee discovered the victim laying between the clearance side of the track and the mine rib at No. 129. EE was unresponsive at this time. EMT arrived-unable revive the victim.

A tree split & fell onto the victim, pinning him between two trees.

Employee was installing the second roof bolt on the right when a large rock fell from the roof (10' x 5' x 8"-10") pinning him to the roof bolter. An MSHA investigation is ongoing.

Miner was drilling a slab shot when the roof collapsed in on him causing fatal injuries.

The victim was walking in an outby direction on the outby side of the scoop, which was being trammed over the victim resulting in fatal crushing injuries.

EE was backing up on stockpile to dump loaed 775D rock truck on oneway stockpile. Rock & truck backed over end of stockpile. Truck flipped over backwards and landed upside down about 30' below. No damage to cab, employee suffered fatal blunt force trauma.

employee was caught between two pieces of equipment resulting in fatal injuries

Based on investigation it is belived that EE climbed up on top of the pan feeder on an extec crusher while it was in operation. This was in violation of company policy & training. EE went through the crusher and was killed.

While atempting to repair a shuttle car without determining that the trailing cable was de-energized and without locking-out and tagging the power source. EE received fatal injries when he cut into an energized phase lead.

EE dug some holes in water, then the ground gave way and the excavator turner over onto side, trapping EE inside.

Employee was backed over by the 988H loader, when the loader operator was backing the machine to turn around.

The victim was positioned next to the continuous mining machine operator in the No. 7 Heading of the 1 North (about 95'inby S.S.#597). The final shuttle car was being loaded from the face of the place, when a piece of roof bolted rock measuring about 71" long X 39" X 18" thick fell, striking the victim. The injuries received from the occurance were fatal.

While repairing hydraulic hose on bolter backfill fell in striking employee.

The victim placed himself where he could get hit by the mining machine.

Victim was removing a machine bottom guard (belly pan) on a Caterpillar D-10 N dozer. Apparently the chain he was using to hold the belly pan while he was removing the bolts that held it in place slipped when the bolts were removed. The belly pan swung down and struck the victim inflicting fatal injuries

While walking outside the warehouse door, next to the loading dock, EE stepped onto the slope part of the loading dock and encountered black ice that could not be seen in the darks. He slid back and landed on his back and his right leg went behind him.

Truck Driver/Customer(350 pounds plus)lost his balance & fell down stairs (older man who just got off light duty work status for his company. Still dealing with high blood pressure.) He was hospitalized and transferred to a rehabilitation center where he died on May 10, 2008.

The victim was using an excavator to free a dragline from an ice-covered pit floor. The excavator traveled over an ice-covered, 10 feet deep ditch and broke through the ice. The victim was ejected and was recovered from the water about 6 hours after accident.

EE traveled to get backsight in order to advance survey station in the #5 entry of the 2nd Butt Right off of South Mains section. The backsight was outby a run-thru check curtain. He was struck by a loaded shuttle car as it traveled from the #6 face to the feeder through the run-thru check, and incurred fatal injuries. He was found by the shuttle car operator on his return trip.

Boom truck being used to set concrete safety barriers beside driveway at the request of MSHA inspector. Boom assy. on truck had approx. 18' clearance under overhead power line. Operator of truck and deceased had just moved truck and reset up to have more clearance under the wires. On first lift the boom was extended too far and made contact with wires. Day was clear, dry and sunny.

The victim (mechanic) removed fuel injector from engine and then instructed his helper to turn the engine over. Diesel fuel and/or air came out of the 1/4 inch injector hole and struck him in the left eye and entered his brain, causing fatal injury.

Employee was walking behind haul truck when truck backed over him.

Two men were working atop an 80 ft silo attempting to reset the chain on a bucket elevator. One man was below and in phone contact with one of the two mechanics atop. As the call was ending, the assisting mechanic atop knocked a 'miner's bar' off the platform. The bar fell and hit the man below on the back of the head. The man died approx. three hours later in the hospital.

Employee somehow fell into the water. There were no witnesses so no details available.
