Employee was dismounting #88270 Prell Truck and his foot slipped causing his left hand/wrist to jam into the platform. Employee went to Scott Orthopedic and was examined by Dr. An x-ray showed a fracture of the fifth metacarpal on his little finger of his left hand. A cast was placed on his left hand and he was released to return to work full duty.

Employee was taking driveline off #305 685 Komatsu Truck. Employee's hard hat fell off and he bent down to pick it up and driveline fell out striking the employee in the top of the head causing a laceration. Employee went to Logan Regional Medical Hospital and received two staples to his head and was released to return to work.

Employee was stepping from the back of his service truck when he missed a step and fell. He attempted to brace himself with his left hand and that is when he suffered a sprain to his left wrist

Employee stated that he strained his right shoulder while attempting to mount a grader.

Employee suffered a laceration to his right middle finger when it was pinched between two wooden crib blocks.

Employee stated that he slipped and fell to the ground while attempting to dismount a D10 dozer.

Sunny & Hot. Stuck bushing was using a sledge hammer and a pin hammer to get it on in. When hammer chipped off and went in left hand.

Employee stated that he strained his lower back when bent over to pick up a rock to mark drill pattern. Employee did not begin missing work until 10/10/13. The lack of medical records caused the slight reporting delay.

Employee stated that he slipped and fell while dismounting truck. Sufficient medical records were unavailable until 5/1/13.

EE was standing on a ladder, attempting to perform repairs to a Caterpillar D10 bulldozer. The ladder slipped out from underneath him causing him to fall striking the push arm of the bulldozer bruising his ribs on the right side.

Employee stated that he was jarred when a rock rolled from the loader bucket and struck the bed cab protector. Medical records were not available until recently.

Employee was removing hydraulic cap bolts (cap was pressurized with oil) and one came loose. The hydraulic pressure cut his work pants and skin on his right knee/shin. He went to MedExpress on 7/29/12 and was released to modified duty; no bending stooping or kneeling until follow up appt 8/4/12.

Employee was granted a 2.2% PPD award for alleged noise induced hearing loss.

Employee was executing repairs to a Komatsu PC5500 hydraulic excavator, during the course of the repair the Automatic Fire Suppression systems was activated and discharged fire extinguishers, employees were covered in the fire suppression material resulting to irritation to eyes and respiratory system

Employee suffered a torn meniscus tendon in his right knee while dismounting a haul truck. Employee did not begin missing work until 4/7/12.

Attempting to attach cables to a bucket of a Komatsu/Demag hydraulic excavator, technician exerted a strain on the cable unaware that the cable hook was caught beneath the bucket, he applied a greater pull on the cable, to free the cable, he experienced an acute pain in the lower lumbar region of his back beginning at his tail bone radiating up the center of his pelvis.

Was installing a solid metal bar on rear axle,wasn't fitting correctly, other tech let go of his end and EE was trying to turn his end and it slipped out and smashed hand.

Working on a Komatsu/Demag PC5500 utilizing a 10 ft ladder, mechanic turned to reach for a hose and felt a sudden sharp pain in lower back Pain radiates up the spinal column, causing problems sitting, pain radiates from lower lumbar area of the spine

EE was granted a 10% PPD award for Occupational Pneumoconiosis by WV OP Board.

Steering pump fell out of spline and hit employee in eye, nose & face. Stitches.

EE alleges to experiencing noise induced hearing loss as a result of his employment with Apogee Coal and was granted a 1% permanent disability award by Chartis.

10% PPD award for Occupational Pneumoconiosis

Employee was exiting the cargo area of his company assigned Sterling Acterra 4900 service truck after retrieving additional tooling, he slipped and twisted his right ankle.

Employee stated that he suffered a jarring injury to his neck while operating a 685 Dresser Haul truck. Medical records concerning this event were not made available until 11/23/10.

A small piece of wire penetrated the back of the employee's left hand while he was putting his tools away. The wire was surgically removed requiring (3) sutures.

EE was installing boom back in saddle on the service truck, winching cable up when the hook caught on the bumper of the service truck, came loose and hit the EE in the head over top left eye.

Employee pinched his right hand in the drill entrance door, resulting in a laceration that required (4) sutures.

Employee tripped on a small gravel pile and fell, resulting in a fractured bone in his left hand.

Had hook up crane to engine and was getting down, stepped off torque and stretched lower left leg. It was burning. Worked next day, was going up and down loader and leg started swelling up.

Employee was diagnosed with an abdominal hernia.

Injury was climbing on 992 G loader. While he was climbing , he felt a pop in his knee. His knee was sore after this.

Employee has been diagnosed with degenerative cervical discs.

Employee was operating a Dresser haul truck when the truck struck a hole in the road, jarring employee's lower back.

Employee was dismounting a loader to check his engine oil when his foot slipped causing him to fall approximately 6 feet down the boarding ladder, injuring his back and left forearm. Medical records were received on 6/30/09. Employee has been absent from work (10) days.

Employee strained his left shoulder when his foot slipped while dismounting a D10 dozer. MRI results were not received until 6/19/09 and other medical records were delayed. This resulted in a reporting delay.

Employee struck his right index finger on a sharp metal edge inside the loader cab, resulting in a laceration.

Employee was climbing over a dozer pusharm when he felt a sharp pain in his lower back. The employee fell backward to the ground. Employee had a previous lower back injury that may have contib uted to this incident.

Employee was lifting a meg welding box (approximately 40 lbs) when he strained his right shoulder. Since this was his first shift of a new rotation, there were no witnesses and this is deer hunting season, the company waited to receive the diagnostic report (MRI) performed on 11/18/2008. The report was received today (11/20/2008).

Employee alleges to experiencing a repetitive motion injury of carpal tunnel syndrome as a result of his employment with Apogee Coal and was granted a 10% permanent disability award by BrickStreet Mutual.

Employee alleges to experiencing noise induced hearing loss as a result of his employment with Apogee Coal and was granted a 3.3% permanent disability award by Avizent.

Walking to deliver part, he tripped and fell injuring left shoulder. Taken by ambulance to ER where dislocated left shoulder was put back into place. He was not admitted to hospital.

Employee's metal wrench slipped, striking him above the right eye brow, resulting in a laceration.

Blaster reportedly suffered an abdominal hernia while raking dry cutting back into blasthole with shovel. Incident happened near beginning of shift on his first day back to work (alternative work schedule).

Approx 10X12' section of haul road collapsed into an abandoned underground miner entry. The right rear tandem of EE's 730 E Dresser fell into void created by this collapse. Truck driver thinks that he cut his finger while dismounting truck afer incident occurred. Note: 3 sutures were placed in the small bliter like flap of skin.

Employee was in the process of dumping his 16th load of rock at dump area, when the truck bed fell approx 2'. The bed did not hit the truck frame but bounced back up to a fully extended position. Employee stated that the jarring motion of the truck caused a "whiplash" type injury to his neck.

On Oct. 11 & 16, employee went to doctor complaining of constant pain radiating down both legs. In an effort to locate the problem, on Oct. 16 employee was told to have an x-ray but failed to do so. On Nov. 4 due to back pain he had neck/back x-rays taken (results normal). On Dec. 13 employee continued to complain of pain so doctor scheduled an MRI. Report received Jan. 4, 2008.

Mechanic was loading track pin into back of service truck when he dropped it on his left foot.

Stepped off catwalk of dozer while steam cleaning, falling to ground.

Occupational Pneumoconiosis

Employee was in back of service truck # 61548 to move heater when he slipped & fell.

Employee got his finger caught in platform step chain while trying to lower the step for dismounting. 2 sutures to close small skin flap.

Driver exited cab, proceeded to hook up hoses to pump off fuel from tanker to storage tanks. Driver slipped and fell on wet leaves before he was able to retrive hoses from storage tray on tanker.

EE removed new rectangular 'Box Type' air filter (3" x 5.5" x 26" long) from cardboard container. Before installing the filter he had to first remove the old one from inside dozer cab. As he was preparing to set the new filter aside, it slipped thru his left hand resulting in a laceration to the palm of his hand near the base of his thumb.

EE was running a hydraulic power cutter, got his hand caught in the hydraulic cylinder causing amputation of left thumb and mutilated his index finger.

Employee was preparing to use a porta-power with ram and jack spacer to push bucket pin from 994 loader. He had leaned the jack spacer piping end-to-end against the loader frame when it fell on top of his right hand.

EE stated that while mounting the 'first step' of #518 dresser truck, he felt a pain in his left side. EE continued to work, but started missing work on October 27 to seek medical attention.

Slipped and fell while mounting D10 dozer. Right elbow struck track on dozer.

EE was opening the lever on a spring loaded fuel cut off valve while the lever was in down position The lever kicked open completely causing the empl- oyee's wrist to be pinched between the lever & the metal bands located near the fuel hose conn- ection.

Occupational Illness (Hearing Loss Claim)

Employee was jarred around in truck. Removed from work pending results of medical testing.(MRI) Determined to be reportable after receiving MRI results on 2/27/06.

Employee missed work on Monday, 2/13/06 to see Dr regarding back pain that he had been having for over a week. X-ray taken on 2/13 was negative so Dr ordered an MRI. Attached MRI findings (rec'd 2/20) show degenerative disc disease along with post surgical changed to employee's back.

Carpal Tunnel Syndrome.

Occupational hearing loss.

Employee was using a chisel to knock the bearing collar off pin on 992 loader. When he struck the chisel with a hammer a metal sliver broke off the chisel & went into employee's forearm.

EMPLOYEE WAS HITTING ON TRACK PIN WITH A 16LB SLEDGE HAMMER WHEN A PIECE OF THE PIN BROKE LOOSE. THE BROKEN PIECE HIT HIM JUST ABOVE LEFT KNEE, LODGING NEAR HIS FEMUR BONE. (NOTE: THIS WAS INITIALLY CHARGED AS A FIRST AID CASE, HOWEVER 4 DAYS LATER HIS DOCTOR DETERMINED THAT METAL NEEDED REMOVED)

ON 5/25/05 EMPLOYEE LEFT WORK COMPLAINING OF BACK PAIN. ON 6/30/05, MRI REPORT WAS RECIEVED SHOWING SPINAL STENOSIS, SPONDYLOLYSIS AND DEGENERATIVE CHANGES HAD OCCURRED TO HIS BACK

EMPLOYEE WAS PREPARING TO REMOVE UPPER SEGMENT BOLTS ON D10 DOZER WHILE POSITIONING AN AIR TORQUE WRENCH SOCKET ONTO ONE OF THE BOLTS WITH HIS LT. HAND, THE TORQUE WRENCH TRIGGER INADVERTENTLY STRUCK THE SEGMENT CAUSING THE WRENCH TO TURN ON. FINGERS WERE PINCHED BETWEEN THE TORQUE WRENCH BRACE & THE MACHINE SPROKET.

EE DISMOUNTED TRUCK LADDER TO LOWER PLATFORM (LOCATED ON BUMPER). HE UNHOOKED THE BOTTOM "SWING DOWN" STEP. AS EE PUSHED ON THE PLATFORM STEP WITH HIS LEFT HAND, THE STEP LIFT CHAIN PINCHED HIS RIGHT MIDDLE FINGER.

EE informed supervisor. toehr on that he tripped over a shank, causing him to fall on another shank, injuring rt. side and lower back.

EE HAS COMPLAINED OF BACK PAIN FOR THE PAST 9 MONTHS. DR REPORT STATES THAT EE MUST CEASE TRUCK DRIVING FOR AT LEAST 6-8 WEEKS.

WORKING ON ENGINE REPLACING LEAKING GASKETS WHICH REQUIRED REMOVING AFTER COOLERS. INJURY OCCURRED WHILE BENDING OVER PICKING UP OIL ABSORBANT PADS ON THE GROUND TO PROPERLY DISPOSE OF & HIS BACK "POPPED" AND FOLLOWED BY LOWER BACK PAIN.

OCCUPATIONAL ILLNESS HEARING LOSS CLAIM.

Employee was hired on 5/27/04 as a mechanic. Due to continuing neck pain, employee had MRI of his neck conducted on 9/10/04. On 9/14/04 employer received MRI results stating that employee had developed spondylosis & facet hypertrophy. (Employee placed on restricted duty on 9/16/04.)

EMPLOYEE STATED THAT HE PICKED UP HARVARD TYPE OIL FILTER & BAIL CAME OUT, CUTTING TWO FINGERS ON RIGHT HAND.

OCCUPATIONAL HEARING LOSS CLAIM

EMPLOYEE WAS CUTTING A TREE WHEN AN UNSEEN GRAPEVINE IN THE TOP OF THE TREE PULLED A DEAD LIMB (6' BY 8") ON HIM, BRUISING HIS SHOULDER AND RIBS.

Employee attempted to push a cut tree using one hand to fall in direction. Employee strained his back.

Employee was cutting trees. When walking from one tree to another he fell and hurt knee. Crew leader notified me of injury on 6-14-04. EE finished shift, went to Dr after work and injury was ruled a swollen knee.

EMPLOYEE REACHED INTO BOTTOM OF AIR CONDITIONING BOX AND CUT HIS FINGER WHEN HE INADVERTENTLY TOUCHED "SQUIRREL CAGE" GEARING.

BONE SPECIALIST PULLED EE OFF WORK ON 4/19/04 AFTER GETTING RESULTS OF MRI THAT WAS COMPLETED ON 4/13/04. EE HAD BEEN SEEING DR FOR "CHRONIC" LOW BACK PAIN. MRI RESULTS: SEVERE DEGENERATIVE DISK DISEASE WITH DISK SPACE NARROWING AT THE L5-S1 LEVEL. ALSO, MILD CHANGES AT THE L3-4 & L4-5 LEVELS.

OCCUPATIONAL ILLNESS, OCCUPATIONAL PNEUMOCONIOSIS.

EMPLOYEE HAD BEEN OPERATING PORTAL BUS AT STARTING TIME. HE GOT OFF BUS TO RELEAVE HIMSELF & UPON RE-ENTRY TO BUS HE SLIPPED & FELL ON ICY SURFACE, LANDING ON HIS LEFT SHOULDER.

EE WAS JARRED AROUND IN TRUCK CAB WHEN HYD EXCAVATOR INADVERTANTLY BUMPED INTO THE SIDE OF HIS TRUCK BED ( TRUCK WAS BEING LOADED) EE NOTIFIED OPERATOR ON DEC 31 THAT HIS NECK PAIN HAD INCREAS ED SINCE THE DEC 1 EVENT TO THE POINT THAT HE DIDN'T FEEL LIKE RETURNING TO WORK.

EMPLOYEE WAS EXITING SERVICE TRUCK, WAS TURNING AROUND STEPPED ON LOOSE ROCKS, LEFT FOOT SLID INTO HOLE, EE FELL TO GROUND STRIKING LEFT ELBOW.

OCCUPATIONAL ILLNESS, OCCUPATIONAL PNEUMOCONIOSIS.
