Investigation is still going on at this time. Per preliminary report: Descending the coal haul road, victim began to lose brakes. He attempted to straddle an axle berm on his left. The truck ran up onto the berm for approximately 100' before it turned over. Victim was found partly out of the passenger side door beneath the right exaust stack. Unable to remove him until EMS arrived.

EE was walking from one crosscut outby the face in the #2 entry toward the face of the #2 entry when he was struck by the #1 shuttle car.

Victim died as a result of an explosion, cause unkown at this time. Received notification on 4/5/2010 that our employee was missing. Received notification late 4/6/2010 that employee was deceased.

Employee was assisting in the movement of supplies at the Justice Mine of Independence Coal Company, Inc. During this process he was apparently pinned between a parts car loaded on a rail car and a rib near the first left switch.

While working a steep backfill slope doing reclaimation work, the dozer operator was unable to maintain control, resulting in rollover of dozer approx 4-5 times. Although wearing seatbelt, a broken back and swelling of C-spine resulted, causing loss of sensation and paralysis.

While atempting to repair a shuttle car without determining that the trailing cable was de-energized and without locking-out and tagging the power source. EE received fatal injries when he cut into an energized phase lead.

Employee and another member were changing a bottom roller on the Cross Hollow belt at the # 130 mine. Injured was laying on the bottom belt changing the roller. The belt suddenly started and traveled approximately 49' before employee fell approximately 39' to the ground. EE passed away on 12/14/07 at 11:30pm.

EE was cropping the clarion level when for unknown reasons he traveled to the top of the ridge and inadvertently contacted a low pressure high volume 16 inch gas line.

EE was backing (rear lights on) on a 636 Long Airdox Shield Hauler 1 break out by the long wall face at cross cut #88 into the #3 left cross cut where he ran over an airlock door top beam which was hidden in the mud. The rear tire hit the beam resulting in the end rising, and entering the operator's compartment causing crushing injuries.

EXCAVATOR OPERATOR WAS LOADING A 785 ROCK TRUCK WHEN THE WALL FELL STRIKING THE OPERATORS COMPARTMENT OF THE MACHINE.

ELECTRICIAN WAS FATALLY ELECTROCUTED WHILE REPAIRING A MINER CABLE. THE CABLE WAS NOT LOCKED AND TAGGED OUT BY THE ELECTRICIAN.

PORTAL VAN PULLED IN FRONT OF A 190 EUCLID ROCK TRUCK. ROCK TRUCK PULLED INTO VAN, CRUSHING THE VAN. IT WAS DARK AT THE TIME OF THE ACCIDENT.

EMPLOYEE WAS IN THE PROCESS OF REPAIRING #3 SHUTTLE CAR CABLE. POWER TO CABLE HAD BEEN TAGGED & LOCKED OUT. HE WAS DISCOVERED LYING ON HIS BACK & NOT BREATHING. CPR WAS ADMINISTERED AND HE WAS TRANSPORTED TO THE HOSPITAL WHERE HE WAS PRONOUNCED DEAD AT APPROX. 8:20 P.M. MSHA/STATE INVESTIGATIONS ARE INCONCLUSIVE AT THIS TIME.

EMPLOYEE, A SECTION FOREMAN ON THE 001-0 MMU WAS IN THE PROCESS OF BACKING A JOY, 12-12, REMOTE CONTROLLED MINER OUT OF THE 2-LEFT CROSSCUT IN ORDER FOR THE SCOOP OPERATOR TO CLEAN THE #2 HEADING. EE WAS STRUCK BY THE BOOM AND PINNED INTO THE RIGHT RIB.

ON WEDNESDAY, JANUARY 2, 2002, EMPLOYEE WAS FATALLY INJURED BY A SUDDEN FALL OF ROOF WHILE OPERATING THE CONTINUOUS MINER IN THE #2 BELT ENTRY (#2 RIGHT BREAK).

EE ENTERED THE MANLIFT TO BE LOWERED TO THE GROUND, AS THE MANLIFT BEGAN TO DESCEND THE SUPPORT TUBE BROKE AND IT APPEARS TO HAVE STRUCK HE IN THIS HEAD. EMT'S ADMINISTERED FIRST AID AT THE JO B SITE UNTIL HEALTH NET WHERE HE PAST AWAY.

EE OPERATING THE CONTINUOUS MINER IN THE #5 ENTRY WHEN A PIECE OF ROCK BROW FELL STRIKING HIM FROM BEHIND RESULTING IN FATAL INJURIES.
