Investigation is still going on at this time. Per preliminary report: Descending the coal haul road, victim began to lose brakes. He attempted to straddle an axle berm on his left. The truck ran up onto the berm for approximately 100' before it turned over. Victim was found partly out of the passenger side door beneath the right exaust stack. Unable to remove him until EMS arrived.

Employee was assisting in the movement of supplies at the Justice Mine of Independence Coal Company, Inc. During this process he was apparently pinned between a parts car loaded on a rail car and a rib near the first left switch.
While working a steep backfill slope doing reclaimation work, the dozer operator was unable to maintain control, resulting in rollover of dozer approx 4-5 times. Although wearing seatbelt, a broken back and swelling of C-spine resulted, causing loss of sensation and paralysis.

EE was backing (rear lights on) on a 636 Long Airdox Shield Hauler 1 break out by the long wall face at cross cut #88 into the #3 left cross cut where he ran over an airlock door top beam which was hidden in the mud. CPR WAS ADMINISTERED AND HE WAS TRANSPORTED TO THE HOSPITAL WHERE HE WAS PRONOUNCED DEAD AT APPROX. 8:20 P.M. MSHA/STATE INVESTIGATIONS ARE INCONCLUSIVE AT THIS TIME.
EMPLOYEE, A SECTION FOREMAN ON THE 001-0 MMU WAS IN THE PROCESS OF BACKING A JOY, 12-12, REMOTE CONTROLLED MINER OUT OF THE 2-LEFT CROSSCUT IN ORDER FOR THE SCOOP OPERATOR TO CLEAN THE #2 HEADING. EE WAS STRUCK BY THE BOOM AND PINNED INTO THE RIGHT RIB.
ON WEDNESDAY, JANUARY 2, 2002, EMPLOYEE WAS FATALLY INJURED BY A SUDDEN FALL OF ROOF WHILE OPERATING THE CONTINUOUS MINER IN THE #2 BELT ENTRY (#2 RIGHT BREAK).
EE ENTERED THE MANLIFT TO BE LOWERED TO THE GROUND, AS THE MANLIFT BEGAN TO DESCEND THE SUPPORT TUBE BROKE AND IT APPEARS TO HAVE STRUCK HE IN THIS HEAD. EMT'S ADMINISTERED FIRST AID AT THE JO B SITE UNTIL HEALTH NET WHERE HE PAST AWAY.
