Mine-safety liability profile

A sample of the liability profile Mining Incidents produces for any of the public issuers that file Dodd-Frank Section 1503 (EX-95) mine-safety disclosures. Built from the public MSHA record joined to the issuer’s own filings: the year-by-year trajectory, the sector-adjusted injury rate, the standing among peer filers, and the per-mine breakout that the disclosures themselves do not give you. Every mine named links to its live record on this site.

ALLIANCE RESOURCE PARTNERS LP ranks 5th of 72 EX-95 filers by fatalities and 6th by proposed penalties over this window, across 46 disclosed mines. Its recordable injury case rate of 5.11 per 200,000 hours runs 1.51x the 3.38 coal-sector national baseline. The profile below gives the year-by-year trajectory, the sector-adjusted rate, and the per-mine breakout that the EX-95 disclosures do not provide.

Methodology and attribution (read first)

Mines appear here because the issuer disclosed them under Dodd-Frank Section 1503, which covers operated and contracted mines alike; the window is held recent so the record reflects the issuer’s current portfolio rather than a predecessor’s. The injury case rate is benchmarked against the coal sector national baseline (98% of the disclosed portfolio is coal; coal carries roughly 1.8× the injury density of metal and nonmetal, so an all-mining comparison would overstate standing). Proposed penalty is the amount MSHA assessed; amount paid is what was collected after contests and settlements. Public-record data, nominal dollars.

Insight. The significant & substantial share (18.5%) is the portion of enforcement judged reasonably likely to cause serious injury, the fraction most relevant to a liability read. Proposed is the assessed figure; the paid figure reflects reductions won in contest.

2026 0 1,034 20.1% $345.7K

Insight. The trajectory is the story the EX-95 filing does not tell: the filing reports one year in isolation, with no trend and no peer frame. The bar tracks proposed penalties relative to this issuer’s own peak year.

Injury case rate vs sector

ALLIANCE RESOURCE PARTNERS LP
5.11
coal national baseline
3.38

Insight. On the OSHA/BLS 200,000-hour basis, the issuer’s recordable case rate is 1.51x the coal-sector national rate, computed over 139 rate-eligible mine-years (four quarters of hours, 20,000+ hours each), so partial years never inflate it.

Basis  200,000-hour OSHA/BLS, operator employees, rate-eligible mine-years only. Benchmarked to the issuer’s dominant sector, not all mining.

5

Pattern-of-Violations status

No disclosed mine in this portfolio has drawn an MSHA Pattern-of-Violations notice within the window. POV is the existential mine-level sanction (production-halting Section 104(e) closure orders); its absence is itself a material data point for a liability read.
