Investigator narrative
An over the road truck driver was crushed while trying to unload gravel. Driver was parked in a jackknife position while trying to unload some of the gravel in EE's bed. While attempting to dump, EE's lift cylinder snapped and the trucks trailer fell on top of the driver's side killing the driver. 911 was called immediately and MSHA was called after.
Final MSHA investigation
On January 2, 2024, at 4:46 a.m., Luis Rivera, a 46 year-old customer truck driver with 19 years of over-the-road truck driving experience, died when his truck’s trailer tipped over onto the cab of the truck. Rivera was in the process of unloading excess material from the trailer when the accident occurred.The accident occurred because Rivera did not properly align the truck and trailer prior to raising the trailer to unload the excess material.
