THE PARTY INVOLVED HAD BEEN WORKING UNDERGROUND THE MORNING 10-15-91. HE HAD BEEN CAR POOLING WITH THE WITNESS DESCRIBED IN #11 SEVERAL OCCASIONS THAT MORNING. HE HAD ASKED THE WITNESS IN FRON T OF ANOTHER WITNESS TO GOT HOME. THE WITNESS TOLD HIM TO TAKE HIS CAR BUT HAVE IT BACK AT 4:00 TO PICK HIM UP.
