VICTIM WAS DRIVING A WAGNER DIESEL POWERED SCOOP OUT OF THE MINE WHEN FOR SOME UNKNOWN REASON, THE SCOOP TRAVELED BACK DOWN THE SLOPE AND THE CANOPY STRUCK AN "I" BEAM ON A OVERCAST WHICH CAUS ED THE CANOPY TO DEFORM, STRIKING THE VICTIM, INFLICTING FATAL INJUIES.
