This is being filed at the request of MSHA. On 3/31/10 torrential rains & flooding throughout S New Jersy overwhelmed the area surrounding the mine & ultimately engulfed the dredging pond. This regional flooding resulted in declaration of federal & state disaster areas. The mine dredging pond is not an impoundment. Co disputes any reportable accident. No impoundment, no failure.

Employee stated that he was standing in the center of the truss support and hooked come-along to lower truss support stacker when truss came loose. His hand was caught in frame and that broke the middle finger in the middle of his right hand.
