MINER HELPER HAD RELEIVED SCOOP OPERATOR OUT FOR DINNER THE SCOOP OPERATOR HAD FNISHED EATING AND RETURNED FOR HIS SCOOP WHEN MINER HELPER REUTRNED HIS SCOOP AGAINST THE OPERATOR ENTERED INTER SECTION STRIKING MINER HELPER WITH BUCKET OF SCOOP AGAINST THE DECK OF OTHER SCOOP THUS CONTRIBUTING INJURY TO MINER HELPER S ADBONDEN AND PELVIS ON HIS LEFT SIDE.
