Employee stated on 8/12/2020 that employee felt some lower back pain after shoveling the previous day. After lengthy evaluation, determined to be a pre-existing degenerative disc condition that was aggravated by work activity.

THE WORKER WENT TO CLOS THE DUMP TRUCK GATE. A ROCK WAS WEDGE UN TE GATE AND WHEN HE REMOVED IT THE GATE SLIPPED OUT OF HIS RIGHT HAND, PINCHING HIS LEFT HAND MIDDLE FINGER. FINGER WAS FRACTUR ED AFTER 1ST JOINT.

THE DRIVER LIFTED THE DUMPBODY TO UNLOAD BUT FAILED TO RELEASE THE TAILGATE. BY FAILING TO RELEASE THE TAILGATE THE DUMP BODY REMAINED FULL WHILE IT WAS BEING RAISED. CONSEQUIENTLY WHEN IT REA CHED THE END OF HIS TRAVEL, IT SHEARED THE DUMP PISTON RETAINING MECHANISM. THIS CAUSED THE DUMP BODY TO SEPERATE FROM THE TRUCK WITH THE ENSUING JARRING ACTION INJURING THE DRIVER.
