El administrado incumplió lo establecido en su instrumento de gestión ambiental, debido a que no acreditó adecuadamente la realización de las acciones contempladas en su Plan de Contingencia respecto a la fuga de relaves ocurrida el 6 de julio de 2019, las cuales son: (i) Aplicar una barrera de contingencia en el área impactada; (ii) Remover del relave derramado y la parte afectada del suelo; (iii) El proceso de limpieza del área afectada deberá ser derivado hacia la presa de relave donde el área de Asuntos Ambientales lo indique; y, (iv) Para reponer la operación de la línea de tuberías de relave se procederá a inspeccionar toda la línea desde su naciente hasta su punto de descarga.
