THE VICTIM HAD POSITIONED HIMSELF ON THE GROUND IN AN AREA OF OBSTRUCTED VIEW TO THE DRIVER OF A SECOND TRUCK WHILE WAITING TO BE LOADED. AS THE SECOND DRIVER PULLED AWAY AFTER BEING LOADED, H E NOTICED HIS TAILGATE HAD NOT CLOSED.
