EMPLOYEE WAS DRIVING FRONT END LOADER TO BACK POND AREA TO PUT FLUID INTO LOADER. WHILE DRIVING,BUCKET CAME ALL THE WAY DOWN INTO DIRT. EMPLOYEE'S HEAD THRUST AGAINST WINDSHIELD CAUSING BRUISE S, PAIN IN NECK AND SHOULDERS.

INJURY OCCURRED WHEN EE WAS PULLING ROPE TO START BOAT MOTOR TO PROCEED TO DREDGE TO BEGIN PUMPING. WENT TO HIS KNEES AND SCREEMED HIS BACK HURT. WITH HELP, HE CRAWLED OT OF BOAT TO LAND AND WAS PUT ON STRETCHER. TAKEN TO NEARBY HOSPITAL VIA AMBULANCE.

THE EE COMPLAINED THE NEXT DAY ABOUT BEING INJURED REMOVING AN OIL PAN FROM DUMP TRUCK. NO INJURY REPORT WAS ISSUED SINCE NO SUPERVISOR REPORTED INJURY. A WORKMEN'S COMPENSATION CLAIM WAS FILE D. HOWEVER, WORKMEN'S COMPENSATION DETERMINED THERE WAS NO CASE. CASE WILL GO TO COURT.
