EMERGENCY SPILL4AY BEING CONSTRUCTED AT TAILINGS POND #3.DURING LOADER CYCLE WHERE DIRT BEING MOVED FROM SPILLWAY BOTTOM,VICTIM CHECKING GRADE IN SPILLWAY BOTTOM.APPEARS THAT VICTIM MOVED TOO CLOSE TO LOADE9 CYCLE.WHEN LOADER BACKED OUT OF BANK,REAR BUMPER HIT DECEASED KNOCKING HIM TO GROUND JUST BEFORE RIGHT REAR TIRE RAN OVER HIM.
