THE VICTIM WAS OPEATING A BACKHOE LOADING WASTE FROM A SETTLEMENT POND INTO HAUL TRUCKS WHEN THE BACKHOE SLIPPED INTO THE POND AND TRAPPED THE VICTIM UNDER WATER.
