WHILE DRIVING CAT 769B END DUMP DOWN AN INCLINE, EE HIT A SLICK SPOT AND LOST CONTROL OF THE TRUCK. THE TRUCK HIT A BERM CAUSING THE TRUCK TO TURN OVER. THE EE RECEIVED BRUISES ON ARM AND CHES T FROM THE TRUCK BATTERY. RAIN HAS BEEN FALLING WHICH PRODUCE THE SLICK CONDITIONS.

THE CO. DOES NOT BELIEVE THIS INCIDENT OCCURRED. THEEE ALLEGES THAT WHEN THE END LOADER DUMPED THE SECOND BUCKET OF COAL IN HIS TRUCK, HIS BACK POPPED. STATEMENTS BY THE ALLEGED VICTIM TO OTHE R EES REVEALED THIS WAS A CON GAME TO DRAW WORKMAN'S COMP. THIS IS THE REASON FOR THE LATE SUBMISSION OF THIS REPORT.
