WATER ERUPTED FROM AN ABANDONED UNDERGROUND MINE SITUATE ON THE COMPANY'S PERMIT NO. S-1028-88. THE COMPANY HAD NOT DISTURBED THE AREA IN WHICH THE WATER ERUPTED AND WAS NOT WORKING ON THE JOB SITE AT THE TIME OF THE INCIDENT. THE GATE TO THE SITE SECURED AT THE TIME OF THE INCIDENT.

EMPLOYEE WAS GREASING ENDLOADER AFTER LUNCH-BREAK, WHILE DOING THIS HE SLIPPED AND FELL OFF THE MACHINE. THERE WAS SNOW AND ICE ON GROUND, THERE COULD HAVE BEEN SOME SNOW ON HIS BOOTS WHICH C ONTRIBUTED TO ACCIDENT
